ARKANSAS SUMMARY OF EXISTING LAW

The state’s fair audit law includes requirements such as: audits must be limited to 25 prescriptions that have been randomly selected; the entity conducting the audit cannot use the accounting practice of extrapolation in calculating recoupments or penalties for audit; a PBM cannot conduct an audit more than twice in any calendar year; a PBM cannot require documentation beyond that which is required by the Arkansas Board of Pharmacy; and there must be an appeals process under which a pharmacy may appeal an unfavorable preliminary audit report to the entity.

PRACTICAL NOTE FOR EXISTING LAW

The state has one of the strongest limitations on the number of claims that a PBM can audit at a given time (25 claims) and number of audits a PBM can conduct in a given 12-month period (2 audits).
