NORTH CAROLINA SUMMARY OF EXISTING LAW

Beneficiaries may choose any pharmacy that has agreed to participate according to the insurer’s terms, and insurers must accept any pharmacy that is willing and able to accept such terms. The statute affords a private cause of action for damages or injunctive relief in favor of any person or pharmacy aggrieved by the violation.

PRACTICAL NOTE FOR EXSISTING LAW

This law provides strong ‘Any Willing Provider Law’ requirements and is one of the strongest in terms affording a ‘private right of action’ for damages or injunctive relief. However, its benefits to physician dispensers may be limited, since it refers to ‘pharmacies.’
