OKLAHOMA SUMMARY OF EXISTING LAW

No third party prescription program administrator shall deny any pharmacy the opportunity to participate in any third party prescription program offered in this state in a manner which will restrain the right of a consumer to select a pharmacy, and no agreement shall establish reimbursement rates which are less than the prevailing rates paid by ordinary consumers for the same or similar legend or nonlegend drugs and pharmaceutical services.

PRACTICAL NOTE FOR EXSISTING LAW

This law provides strong ‘Any Willing Provider Law’ requirements, and includes a specific requirement that reimbursement rates be fair and reasonable. However, its benefits to physician dispensers may be limited, since it refers to ‘pharmacies.’
