OHIO SUMMARY OF EXISTING LAW

The law requires PBMs to update MAC price lists weekly. MAC lists must be provided to pharmacies within 10 days of a request. The law creates a 21 day MAC appeals process, with disclosure of where Ohio pharmacies can purchase denied appeal drug by NDC at that PBM’s MAC price.

PRACTICAL NOTE FOR EXISTING LAW

The new law regulates PBMs as third-party administrators making their actions under their contracts subject to state regulation. The law also creates stronger PBM penalties. Interestingly, the law also requires PBMs to disclose to plan sponsors whether the PBM uses the same MAC list when billing a plan sponsor as it does when reimbursing a pharmacy.
