Prior to conducting business in the State of West Virginia, a auditing entity shall register with the Insurance Commissioner. A PBM that is registered as a third-party administrator, is not required to register separately as an auditing entity.

This is a fairly sufficient statute for licensure, which, in tandem with other existing PBM laws, provides a framework for regulatory oversight of PBMs as well as rights for pharmacy providers.
