White Bagging Law – GEORGIA

GEORGIA SUMMARY OF EXISTING LAW

Anti-steering law which prohibits pharmacies rom entering into agreements with affiliates for purposes of sending prescriptions to a specific pharmacy. Prohibits pharmacies from presenting (or PBM from paying) claims for reimbursement that were received pursuant to a referral from an affiliated PBM.

PRACTICAL NOTE FOR EXISTING LAW

While the law is silent as to white bagging and/or brown bagging, the provisions could be used to prohibit a PBM from requiring a patient to obtain even administered medication from a specific, affiliated pharamcy. The law would not, however, prohibit a plan from moving a drug from a medical benefit to a pharmacy benefit.
